Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PromptWriter (“Service”), operated by PromptWriter (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms in full. If you do not agree, do not use the Service.

1. Description of Service

PromptWriter is an AI-powered prompt engineering tool that transforms plain-language requests into structured, high-quality prompts suitable for use with large language models. The Service is accessed via a web application and requires account registration.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms. By using the Service, you represent that you meet these requirements.

3. Account Registration

You must provide a valid email address and password to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to terminate accounts that violate these Terms, are inactive for an extended period, or are associated with fraudulent activity.

4. Credits and Payments

The Service operates on a credit-based system with a daily free usage allowance. Signed-in users receive up to 5 free prompts per day (reset at midnight). Additional paid credits are available for purchase in packs at the prices listed on our Pricing page.

All sales are final. Credits are non-refundable and non-transferable. Credits do not expire and are tied to your account.

Payments are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's terms of service. We do not store your full payment card details.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Generate content intended to deceive, defraud, or mislead others
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of any person or entity
• Attempt to reverse-engineer, scrape, or extract the underlying AI models or system prompts
• Resell, sublicense, or otherwise commercialize your access to the Service without our written consent
• Use automated means to access the Service beyond normal usage patterns

6. Your Content

You retain ownership of the text you submit to the Service (“Input”) and the prompts generated (“Output”). You are solely responsible for ensuring your Input and use of Output comply with applicable laws.

By using the Service, you grant us a limited, non-exclusive license to process your Input solely to provide the Service. We do not train our own AI models on your Input. Inputs may be transmitted to third-party AI providers (including Google and Anthropic) solely for the purpose of generating your Output.

7. AI Output Disclaimer

The Service uses AI to generate content. AI-generated outputs may be inaccurate, incomplete, or inappropriate for your specific needs. You are solely responsible for reviewing, editing, and using any Output generated by the Service. We make no warranties as to the accuracy, fitness for purpose, or legality of AI-generated content.

8. Intellectual Property

The Service, including its design, code, branding, and system prompts, is owned by PromptWriter and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMPTWRITER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Service. Upon termination, your right to use the Service ceases immediately. Unused credits are non-refundable upon termination for violations.

12. Changes to Terms

We may update these Terms at any time. When we make material changes, we will update the “Last updated” date above. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.
